Statut Rom Lindungi Dari Ancaman Luar dan Dalam

26 April 2019: Baru-baru ini, Kebinet telah memutuskan Malaysia menarik diri daripada Statut Rom Mahkamah Jenayah Antarabangsa (ICC) kerana kekeliruan yang timbul dalam masyarakat berkenaan dengan isu tersebut.

Profesor Fakulti Undang-Undang (FUU), Universiti Kebangsaan Malaysia (UKM), Prof Datin Dr Faridah Jalil berkata, walaupun Malaysia telah memutuskan untuk menarik diri, namun tindakan meratifikasi Statut Rom mampu melindungi Malaysia daripada ancaman luar dan dalam negara berkenaan empat jenayah antarabangsa iaitu pembunuhan beramai-ramai, jenayah perang, jenayah kemanusiaan dan pencerobohan.

Beliau berkata, ICC adalah mahkamah pilihan terakhir apabila negara yang terbabit gagal atau tidak mampu mengambil apa-apa tindakan terhadap pesalah jenayah tersebut.

“Tujuan ICC dan mahkamah di negara kita adalah berbeza. ICC akan memberi laluan untuk mendapatkan legal redress yang mereka tidak boleh dapat dari mahkamah negara pihak.

“Bidang kuasa ICC bukan automatik, tidak ada universal jurisdiction, ada syarat-syarat yang perlu dipenuhi untuk mendapatkan bidang kuasa membicarakan terutamanya mahkamah negara tersebut enggan, gagal atau tidak ada remedi bagi kesalahan-kesalahan jenayah yang disebutkan dalam Statut Rom,” katanya semasa Bicara Persada bertajuk Statut Rom: Malaysia ke Arah Mana? di Persada Canselori, UKM.

Selain itu, Ketua Eksekutif, Pusat Penyelidikan dan Advokasi Hak Asasi Manusia (CENTHRA), Azril Mohd Amin berkata, pengumuman Malaysia menarik diri daripada Statut Rom dibuat berikutan kekeliruan yang timbul dari segi politik dan dalam kalangan masyarakat.

“Kita setuju untuk tidak meratifikasi tetapi keutamaan kita sekarang ini apa? Untuk kita memastikan bahawa kita boleh menggunakan ICC ini sebagai satu bantuan khususnya umat Islam di Palestin dan Rohingya,” katanya.

Bicara Persada tersebut turut dibarisi oleh Peguam, Mohd Khairul Azam Abdul Aziz dan aktivis, Asheeq Ali Sethi Alivi sebagai ahli panel dan menampilkan Prof Dato’ Noor Aziah Mohd Awal, Profesor di FUU sebagai moderator.
