Siyāsah shar‘iyyah merupakan satu sistem pentadbiran politik Islam yang mempunyai kuasa mentadbir dan menjadi penyelesai konflik antara agama berdasarkan pemahaman al-Quran dan hadith serta pandangan mujtahid berkaitan kenegaraan. Dalam sesebuah negara, non-muslim yang tinggal dalam negara Islam adalah tertakluk kepada hukum ahl al-dhimmah yang perlu dijaga hak-hak mereka selagi tidak menyentuh bidang akidah dan ibadat. Perbincangan dalam artikel ini berkaitan pengurusan baitulmal setelah harta pusaka berkenaan telah menjadi harta miliknya dan ia terkeluar daripada hukum faraid kerana baitulmal telah menerima harta pusaka mualaf. Sehubungan dengan itu, objektif artikel adalah membincangkan pendekatan siyāsah shar‘iyyah yang diaplikasi oleh pengurusan baitulmal dalam menyantuni tuntutan ahli keluarga non-muslim terhadap harta pusaka mualaf yang telah meninggal dunia. Kajian kualitatif ini mengumpul data dan maklumat melalui kaedah analisis kandungan dan temu bual terhadap informan-informan yang terdiri daripada pegawai-pegawai baitulmal negeri yang terlibat secara langsung dalam tuntutan harta pusaka mualaf. Seterusnya, penganalisisan data-data ini adalah menggunakan pendekatan deskriptif dan komparatif. Hasil kajian mendapati bahawa wujud pendekatan siyāsah shar‘iyyah dilaksanakan oleh pengurusan baitulmal dalam menyantuni tuntutan ahli keluarga non-muslim terhadap harta pusaka mualaf di Malaysia bagi menjamin kelangsungan dakwah pada masa akan datang. Namun baitulmal berhak menolak permohonan atau rayuan daripada ahli keluarga non-muslim sekiranya terdapat elemen-elemen seperti pernah terjadi penghinaan kepada agama Islam dan tidak mempunyai hubungan baik dengan si mati mualaf setelah memeluk Islam.

Siyāsah shar‘iyyah is an Islamic political administration system that has the power to govern and resolve conflicts between religions based on the understanding of the al-Quran and hadith as well as the views of mujtahids related to statehood. In a country, non-muslims living in an Islamic countries are subject to the laws of ahl al-dhimmah who need to protect their rights as long as they do not touch the area of faith and worship. The discussion in this article is related to the management of the baitulmal after the inheritance has become its rightful property and it is out of faraid law because the baitulmal has received the inheritance of converts. In relation to that, the objective of the article is to discuss the siyāsah shar‘iyyah approach applied by the management of the baitulmal in accommodating the claims of non-muslim family members on the estate of converts who have died. This qualitative study collects data and information through content analysis methods and interviews with informants who are state baitulmal officials who are directly involved in the claim of the convert’s inheritance. The analysis of these data is using a descriptive and comparative approach. The result of the study found that there is the concept of siyāsah shar‘iyyah approach implemented by the baitulmal management in accommodating the demands of non-muslim family members of the inheritance of converts in Malaysia carried out through shura to ensure the continuity of da‘wah in the future. However, Baitulmal has the right to reject applications or appeals from non-Muslim family members if there are elements such as insults to Islam and not having a good relationship with the deceased who converted to Islam.
