Meskipun pindaan ke atas Akta Pengangkutan Jalan 1987 telah dikuatkuasakan, namun bilangan kes tetap bertambah. Artikel ini bertujuan untuk menganalisis hukum syarak dan perundangan Islam dalam menangani isu ini. Beberapa aspek disoroti iaitu konsep undang-undang jenayah mabuk dan minum arak, kecederaan dan bunuh, falsafah hukuman serta elemen pencegahan menerusi fiqah al-jin\u0101yat. Permasalahan asas melibatkan penentuan hukuman yang bersesuaian turut dibincangkan. Metodologi bagi kajian ini adalah kualitatif. Data bagi kajian ini diperoleh menerusi kaedah kepustakaan dan dianalisis secara tematik dan deskriptif. Kajian ini mendapati bahawa ketegasan syariat Islam dalam menangani jenayah tidak hanya ketika mana berlakunya jenayah dan hukuman, namun seiring dengan pembelaan seadilnya. Despite the amendment of Road Transport Act 1987, the number of cases continuing to increase. This article aims to analyze Islamic law and Islamic jurisprudence in order to counter this issue. Several aspects are highlighted; the concept of the criminal law of drunkenness and drinking, injury and murder, the philosophy of punishment and the element of prevention through fiqah al-jin\u0101yat. Basic problems involving the determination of appropriate punishment are also discussed. The methodology of this research is qualitative. Data obtained for this study were through library methods and analyzed thematically and descriptively.
