global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>Tanah adat di Negeri Sembilan berasaskan adat perpatih yang mesti dikekalkan secara turun temurun secara warisan dan jagaan wanita, maka tidak boleh dijual beli. Namun, apabila berlaku pengambilalihan oleh kerajaan maka timbul persoalan apakah ia dibenarkan oleh undang-undang dan juga hukum syarak. Oleh itu, objektif artikel ini adalah untuk mengenal pasti status tanah adat yang telah bertukar taraf dari perspektif perundangan dan hukum. Kajian ini adalah kajian kualitatif dengan pendekatan kajian kes. Pengumpulan data dilakukan melalui analisis dokumen. Hasil kajian mendapati bahawa pengambilan tanah adat di Negeri Sembilan oleh pihak kerajaan adalah dibenarkan dari segi undang-undang. Begitu juga dengan hukum adat kerana ia boleh berubah setelah mendapat persetujuan Ketua Adat dan ahli suku yang lain. The issue arises if it is taken over by the Government whether it is permitted by the law as well as Islamic jurisprudence. Therefore, the objective of this article is to identify the status of customary land which has been changed from the legal and Islamic perspective. This study is a qualitative study using case study approach. Data collection is done through document analysis method. The result shows that the acquisition of land in Negeri Sembilan by the Government is permitted by the law. Similarly, customary law can be changed after the approval of a custom head and the other members of the tribe.
