Tahanan pencegahan merupakan suatu instrumen yang diwujudkan oleh pihak kerajaan dalam usaha mengekang dan mencegah jenayah bagi menjamin keselamatan dan keharmonian dalam masyarakat. Namun begitu, perkara ini tidak mengetepikan keperluan untuk penelitiannya menerusi suluhan fiqh Islami. Terdapat al-Qaw\u0101id al-Fiqhiyyah tertentu boleh diaplikasikan dalam konteks pelaksanaan tahanan pencegahan di bawah undang-undang jenayah di Malaysia. Oleh itu, artikel ini mengulas aplikasi al-Qawaid al-Fiqhiyyah yang berkaitan dengan berkaitan instrumen tahanan pencegahan. Artikel kualitatif ini merupakan suatu kajian kepustakaan yang melibatkan metode pengumpulan data yang dikumpul dari tulisan dan makalah kajian. Hasil dapatan artikel ini menjelaskan terdapat enam qawaid al-fiqhiyyah yang berautoriti untuk diaplikasikan dalam tahanan pencegahan supaya memberi kesan yang positif terhadap penerimaan guna pakainya.\u00a0\u00a0<\/p>\n<p>KATA KUNCI\u00a0<br \/>Al-Qaw\u0101id al-Fiqhiyyah, Tahanan Pencegahan, Keadilan, Keselamatan Awam, Hak individu.\u00a0<\/p>\n<p>[\/et_pb_tab][et_pb_tab title=&#8221;Abstract&#8221; _builder_version=&#8221;4.23.1&#8243; _module_preset=&#8221;default&#8221; body_text_align=&#8221;justify&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>al-Qawaid al-Fiqhiyyah is one of the guides for resolving legal issues related to the new developments and socio-cultural complexities of society. Preventive detention is an instrument created by the government to prevent crime, ensuring safety and harmony in society. However, this does not negate the need for research through Islamic jurisprudence. Certain al-Qawaid al-Fiqhiyyah principles can be applied in the context of implementing preventive detention under criminal law in Malaysia. Therefore, this qualitative article discusses the application of al-Qawaid al-Fiqhiyyah related to preventive detention instruments. This literature review article involves data collection through writings and research papers. The findings of this article explain that there are six authoritative al-Fiqhiyyah principles that can be applied in preventive detention to have a positive impact on its acceptance and
