_builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; body_text_align=&#8221;justify&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>Kajian ini membincangkan isu jenayah merempit yang semakin membimbangkan masyarakat di Malaysia kerana bukan sahaja membahayakan nyawa pelaku, malah turut mengancam keselamatan pengguna jalan raya. Statistik menunjukkan peningkatan kemalangan dan kematian yang melibatkan penunggang motosikal, dan sebahagian daripadanya dikaitkan dengan perlakuan berisiko seperti merempit, tindakan melulu, pengaruh rakan sebaya serta kelompangan dalam peruntukan undang-undang. Objektif kajian ini adalah untuk mengenal pasti faktor yang mendorong peningkatan kes merempit, menganalisis peruntukan perundangan sivil dan hukum Islam yang berkaitan, serta menilai impaknya terhadap pelaku dan mangsa. Kajian ini menggunakan pendekatan kualitatif melalui kaedah kepustakaan, dengan data dianalisis secara deskriptif dan tematik berdasarkan akta, fatwa negeri, jurnal akademik, serta laporan media. Hasil kajian menunjukkan bahawa peningkatan kes merempit dipengaruhi faktor sosial dan kelemahan penguatkuasaan. Hukuman sivil di bawah Akta Pengangkutan Jalan 1987 didapati masih kurang berkesan, manakala dari perspektif Islam, perbuatan merempit dikategorikan sebagai kesalahan Ta\u2018zir kerana tiada hukuman khusus ditetapkan dalam al-Quran dan al-Sunnah. Namun begitu, ia membawa kemudaratan kepada diri dan orang lain, mengganggu ketenteraman awam, serta bertentangan dengan Maqasid Shari\u2018ah khususnya pemeliharaan nyawa (hifz al-nafs). Implikasi kajian menegaskan keperluan kerjasama antara pihak berkuasa, pembuat dasar dan masyarakat dalam memperkukuh mekanisme pencegahan jenayah merempit, di samping memperkasa pendidikan moral dan agama sebagai strategi berterusan, selaras dengan Agenda 2030 Pembangunan Mampan khususnya SDG 3 dan SDG 16.<\/p>\n<p>KATA KUNCI<br \/>Jenayah merempit, perundangan sivil, Maqasid Shari\u2018ah.<\/p>\n<p>[\/et_pb_tab][et_pb_tab title=&#8221;Abstract&#8221; _builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; body_text_align=&#8221;justify&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>This study discusses the increasingly alarming issue of illegal street racing in Malaysia, which not only endangers the lives of perpetrators but also threatens the safety of other road users. Statistics show an increase in accidents and deaths involving motorcyclists, some of which are associated with risky behaviours such as street racing, reckless actions, peer influence, and gaps in legal provisions. The objectives of this study are to identify the factors driving the increase in illegal street racing cases, to analyze the relevant civil and Islamic legal provisions, and to evaluate its impact on both perpetrators and victims. This study uses a qualitative approach through library research, with data analysed descriptively and thematically based on legal acts, state fatwas, academic journals, and media reports. The findings of the study indicate that the increase in illegal street racing cases is influenced by social factors and weaknesses in law enforcement. Existing civil penalties under the Road Transport Act 1987 are still found to be less effective, while from an Islamic perspective, street racing is categorized as a Ta\u2018zir offence, because there is no specific punishment stipulated in the Quran and Sunnah. Nevertheless, it causes harm to oneself and others, disrupts public order, and contradicts the Maqasid Shari\u2018ah, particularly the preservation of life (hifz al-nafs).
