Menjelang tahun 2030, Malaysia dijangka menjadi sebuah negara tua apabila lebih 15% penduduknya berusia 60 tahun ke atas. Peningkatan populasi warga emas ini turut disertai dengan laporan pengabaian dan penderaan, sekali gus menimbulkan persoalan tentang keberkesanan perlindungan undang-undang terhadap golongan ini, khususnya berkaitan tanggungjawab anak terhadap ibu bapa. Dalam masyarakat yang berteraskan nilai kekeluargaan, penting untuk menilai sejauh mana konsep tanggungjawab filial diiktiraf dan dilindungi di sisi undang-undang. Kajian ini bertujuan mengenal pasti kedudukan semasa undang-undang berkaitan tanggungjawab anak terhadap ibu bapa di Malaysia, menilai keperluan penggubalan undang-undang filial, serta mencadangkan model perundangan yang sesuai. Pendekatan kualitatif digunakan melalui kajian kepustakaan dan analisis dokumen, disertai kajian perbandingan dengan negara seperti Singapura dan India yang telah menggubal undang-undang filial. Hasil kajian mendapatidari segi perundangan sivil, Malaysia masih belum mempunyai peruntukan khusus secara eksplisit berkaitan tanggungjawab filial. Perbandingan menunjukkan bahawa undang-undang filial berupaya menangani isu pengabaian warga emas dengan mewajibkan anak-anak memberi nafkah dan perlindungan kepada ibu bapa. Oleh itu, wujud keperluan mendesak untuk mewujudkan kerangka perundangan khusus bagi tujuan ini. Secara keseluruhannya, kajian ini menegaskan bahawa penggubalan undang-undang filial adalah wajar dan perlu diberi keutamaan demi memastikan hak serta kebajikan ibu bapa tua di Malaysia terpelihara secara berkesan.<\/p>\n

By the year 2030, Malaysia will be an ageing population with over 15% of its population being 60 years old and above. The ageing population is reflected by increasing cases of abuse and neglect that have also brought into serious consideration the issue of the adequacy of legal protection for this population, most particularly on the duty of children towards their ageing parents. In a family-oriented society, one must consider how the notion of filial duty is legalized and safeguarded under law. This research would seek to settle the existing legal position in Malaysia on children’s duties toward their parents, assess whether filial responsibility law is needed, and suggest an appropriate legal framework. A qualitative method was utilized by means of library research and document study combined with comparative studies of countries such as Singapore and India, which implemented filial responsibility law. Results indicate that Malaysia currently lacks firm legal provisions pertaining to filial responsibility. Comparative analysis suggests that filial legislation helps to ensure that the rights and well-being of elderly parents in Malaysia are effectively protected.<\/em><\/p>\nKEYWORDS
