_builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; body_text_align=&#8221;justify&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>Artikel ini meneliti cabaran pengurusan harta pusaka mualaf melalui analisis perbezaan pandangan fuqaha\u2019 terhadap pewarisan antara Muslim dan bukan Muslim, serta implikasinya dalam konteks masyarakat majmuk di Malaysia. Perbahasan memfokuskan kedudukan mualaf sama ada sebagai pewaris atau pewaris yang berpotensi, khususnya apabila wujud hubungan kekeluargaan terdekat yang masih bukan Islam. Kajian ini menggunakan pendekatan kualitatif berbentuk analisis dokumen dengan menilai hujah dan prinsip pewarisan daripada empat mazhab utama (Hanafi, Maliki, Syafi\u2019i dan Hanbali) serta sorotan pandangan kontemporari. Dapatan menunjukkan wujud ketegasan majoriti mazhab terhadap prinsip perbezaan agama sebagai penghalang pewarisan, namun terdapat perincian dan nuansa tertentu pada tahap aplikasi, termasuk keadaan waris memeluk Islam sebelum pembahagian pusaka serta pertimbangan maslahah dalam wacana kontemporari. Artikel ini turut mengenal pasti punca kekeliruan dalam kalangan mualaf dan waris, antaranya perbezaan ijtihad mazhab, kelemahan kefahaman hukum faraid, ketidakseragaman pelaksanaan fatwa antara negeri, serta kurangnya pendidikan proaktif institusi agama dan perundangan. Kesannya, pengurusan pusaka mualaf cenderung berhadapan kelewatan, pertikaian bidang kuasa dan risiko harta tidak dituntut. Justeru, artikel ini mencadangkan keperluan penyelarasan panduan, pemerkasaan literasi faraid, dan mekanisme penerangan yang lebih sistematik bagi melindungi hak mualaf selaras dengan maqasid Syariah.<\/p>\n<p>Kata Kunci<br \/>Mualaf, harta pusaka, pewarisan silang agama, fatwa, bidang kuasa mahkamah<\/p>\n<p>[\/et_pb_tab][et_pb_tab title=&#8221;Abstract&#8221; _builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; body_text_align=&#8221;justify&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>This article examines the challenges of managing the estates of converts to Islam (muallaf) through an analysis of juristic differences among classical Muslim scholars (fuqaha\u2019) on inheritance between Muslims and non-Muslims, and the practical implications of these differences within Malaysia\u2019s multi-religious society. The discussion focuses on the legal position of the muallaf as an heir (or potential heir), particularly in situations where close family members remain non-Muslim. This study adopts a qualitative, in the form of analysis (library-based) approach by analysing the evidences, reasoning, and inheritance principles advanced by the four main Sunni schools of law (Hanafi, Shafi\u2019I, and Hanbali), alongside selected contemporary perspectives. The findings indicate that the majority position maintains a firm rule that difference of religion constitutes a bar to inheritance; however, the schools differ in certain application-level details; including scenarios where an heir embraces Islam prior to the distribution of the estate and discussions on public interest (maslahah) in contemporary discourse. The article also identifies key drivers of confusion among converts and heirs, including divergent juristic opinions, limited understanding of faraid, non-uniformity in fatwa implementation across states, and insufficient proactive outreach by religious and legal institutions. These factors contribute to delays, jurisdictional disputes, and the risk of unclaimed estates.
