STATELESS COMMUNITIES IN THE MALAYSIAN CONTEXT

Abstract
In 2023, Malaysia passed significant amendments to its citizenship laws, marking a milestone in addressing statelessness and ensuring access to nationality for vulnerable groups. While these reforms introduced provisions aimed at enhancing gender equality and improving protections for children born abroad to Malaysian mothers, key gaps remain unresolved. This presentation critically examines the implications of these amendments, focusing on their effectiveness in safeguarding the right to nationality and their alignment with international human rights standards. The discussion will further underscore actionable recommendations for harmonizing domestic laws with applicable norms and ensuring equitable access to legal identity in Malaysia’s multi-ethnic society.
Presenter’s Profile
Rodziana Mohamed Razali (LL.B. (Hons) (IIUM), LL.M. (Melbourne), Ph.D. (UKM)) holds a lectureship position at Universiti Sains Islam Malaysia and has taught courses in the field of law, including International Law, Human Rights Law, Migration Law and Equity and Trusts. She was previously in the Judicial and Legal Service and was called to the Malaysian Bar as an Advocate and Solicitor of the High Court of Malaya in 2016. In 2018, she was awarded the Arnold and Steinberg Postdoctoral Fellowship in International Migration Law and Policy by McGill University, Canada. She was also a visiting scholar at Waseda University, Japan, Suleyman Demirel University, Republic of Turkey, and Maastrich University, The Netherlands. Her primary areas of research interests include birth registration, legal identity and prevention of statelessness, and laws and policies addressing stateless, refugees and labour migrants. She has conducted consultation and research projects with UNICEF, UNHCR, Ministry of Home Affairs Malaysia and several local and international civil society organisations. Her works have been published, among others, by Springer Nature, World Scientific, and several Scopus/ISI-indexed journals.
