الحوكمة الرشيدة لمؤسسات الزكاة في فلسطين على ضوء الشريعة الإسلامية
Good Governance of Zakat Institutions in Palestine In Light of Islamic Law

الكفاءة والفعالية وتحقيق الشفافية، ? تلقى الحوكمة الرشيدة في الآونة الأخيرة اهتماماً متزايداً في أقطار العالم؛ وذلك لدورها الكبير في ز ومعالجة المشكلات الإدارية، ومكافحة الفساد المالي والإداري. ولقد ﺗﺄثرت كافة القطاعات الفلسطينية بشكل سلبي نتيجة للانقسام الفلسطيني الذي أثر على كافة المؤسسات العاملة في فلسطين بما في ذلك مؤسسات الزكاة. ﺑﺎتباع المنهج الوصفي التحليلي، يهدف هذا البحث إلى بيان مدى تطبيق مبادئ ومعايير الحوكمة الرشيدة في مؤسسات الزكاة في فلسطين على ضوء الشريعة الإسلامية. وتشير أبرز نتائج هذا البحث إلى أنَّ الشريعة الإسلامية سبقت جميع المنظمات الدولية والمؤسسات العالمية بقرون في إرساء المبادئ العامة للحكومة الرشيدة، وأنَّ هناك ضعف في تطبيق معظم معايير الحوكمة الرشيدة في مؤسسات الزكاة في فلسطين نتيجة للانقسام السياسي الفلسطيني اء الانقسام الفلسطيني، وتفعيل اﻟﻤﺠلس التشريعي ليأخذ دوره التشريعي ? والاحتلال الإسرائيلي. ويوصي هذا البحث بضرورة الإسراع في إ دي في بناء منظومة الحوكمة الرشيدة، وتشكيل لجان لمراجعة التشريعات الفلسطينية المتعلقة ﺑﺎلزكاة والعمل على توحيد ه ا ? والرقابي والر وتعديلها بما يحقق مبادئ ومعايير الحوكمة الرشيدة، والعمل على تطبيق مبادئ الحوكمة الرشيدة في كافة مؤسسات الزكاة في فلسطين. دة كفاءة وفعالية مؤسسات الزكاة الفلسطينية لتؤدي دورها على الوجه ? ا ز ? وتكمن فائدة هذا البحث فيما يقدمه من توصيات من شأ
الأمثل.

In recent years, good governance has received growing attention across the globe due to its critical role in enhancing efficiency and effectiveness, promoting transparency, addressing administrative challenges, and combating financial and administrative corruption. The Palestinian sectors, including zakat institutions, have been adversely affected by the ongoing political division, which has negatively impacted the performance of all institutions operating in Palestine. This study adopts its legislative, supervisory, and leadership roles in establishing a governance framework. It further calls for the formation of specialized committees to review, unify, and amend zakat-related legislation in alignment with good goveegislative, supervisory, and leadership roles in establishing a governance framework. Finally, it advocates for the systematic application of these principles across all zakat institutions in Palestine. This research contributes valuable recommendations that aim to improve the efficiency and effectiveness of Palestinian zakat institutions, enabling them to fulfil their roles in an optimal and accountable manner.
